ZoneIn
These Terms of Service govern your access to and use of the ZoneIn iOS application, related app extensions, in-app purchase features, support services, and the ZoneIn website at tryzonein.com.
Important legal notice. These Terms include an arbitration agreement, class-action waiver, and jury-trial waiver. They also include important safety disclaimers about self-imposed app blocking, emergency and critical-use apps, Hard Mode app-removal restriction behavior, Apple Screen Time permissions, one-time consumable paid overrides, and limitations of liability.
1. Acceptance of Terms
These Terms of Service, together with the ZoneIn Privacy Policy at tryzonein.com/privacy and any additional notices presented in the App (collectively, the “Terms”), form a binding agreement between you and Tash-had Saqif (“ZoneIn,” “Developer,” “we,” “us,” or “our”).
By downloading, installing, signing in, accessing, creating or using a focus session or schedule, making an in-app purchase, tapping to accept, or otherwise using ZoneIn, you agree to these Terms. If you do not agree, do not use ZoneIn and delete it from your device before starting any active block.
These Terms are intended to be a custom end-user license agreement for the ZoneIn app. If there is any conflict between these Terms and Apple’s App Store terms, Apple’s terms apply to your use of Apple services, the App Store, Apple in-app purchases, your Apple Account, and Apple devices.
2. Provider and Co-Developer
ZoneIn is released under the personal name of Tash-had Saqif, an individual located in New York, New York, United States. The App is co-developed by Elijah Kajinic, who jointly owns the code, assets, designs, and content of ZoneIn with Tash-had Saqif.
For purposes of these Terms, the “Developer Parties” means Tash-had Saqif, Elijah Kajinic, and their respective successors, permitted assigns, service providers, licensors, and agents. The App is made available to users by Tash-had Saqif, even though the intellectual property is jointly owned by Tash-had Saqif and Elijah Kajinic.
Required developer contact details are listed in Section 24.
3. Eligibility and Minors
The App Store age rating for ZoneIn may be listed as 4+. That rating is a content rating, not a statement that a child has legal capacity to enter into these Terms or that ZoneIn is directed to young children.
ZoneIn is intended for a general audience and is primarily directed to users age 13 and older. ZoneIn is not a Kids Category app and is not directed to children under 13.
If you are under the age of majority where you live, your parent or legal guardian must review and accept these Terms on your behalf and supervise your use of the App. If you are a parent or guardian permitting a minor to use ZoneIn, you are responsible for that minor’s use of the App and for the minor’s selections of apps, websites, categories, schedules, and paid overrides.
ZoneIn is a self-management and digital-wellbeing tool. It is not designed, marketed, or provided as a parental-control, child-safeguarding, child-monitoring, medical, mental-health, addiction-treatment, or emergency-response product.
4. What ZoneIn Does
ZoneIn helps you create self-imposed blocks on apps, app categories, websites, and web-domain categories that you choose. You can start an immediate focus session or create recurring schedules. During an active block, selected apps or websites may be shielded or unavailable until the block ends, until an applicable override is active, or until restrictions are otherwise removed through supported iOS and ZoneIn behavior.
Core features may include:
- Immediate focus sessions that start when you create them.
- Recurring schedules based on selected times and days.
- Blocking of selected apps, app categories, websites, and web-domain categories through Apple Screen Time APIs.
- Custom shield screens that tell you that you are “Zoned In” and direct you back to ZoneIn for an override.
- Screen-time dashboard views using Apple Device Activity reporting.
- Notifications for scheduled-block warnings and one-time first-block reminders, if you grant notification permission.
- Optional paid overrides that temporarily suspend active blocks.
- A Hard Mode feature, described further below.
ZoneIn is intentionally designed so that active blocks and recurring schedules may continue operating when the main App is not open. Blocks may be enforced by iOS extensions and Apple Screen Time functionality, and blocks may automatically re-engage when an override expires.
ZoneIn depends on Apple frameworks, operating-system permissions, iOS behavior, device state, App Store infrastructure, RevenueCat purchase infrastructure, Firebase services, and third-party SDKs. The App may not work correctly if those systems fail, change, become unavailable, are disabled, are restricted by Apple, are limited by quotas, or are revoked by you.
5. Emergency and Critical-Use Acknowledgment
Read this section carefully before starting any block. ZoneIn blocks apps and websites of your own choosing. Blocking certain apps may have serious consequences. You alone are responsible for deciding what to block and when to block it.
You acknowledge and agree that:
- You alone decide what to block. You choose the apps, websites, categories, schedules, durations, and sessions.
- ZoneIn does not evaluate your choices. The App does not determine whether a selected app is safe, medically necessary, work-critical, financially important, legally required, accessible, or needed for emergencies.
- Emergency calling remains handled by iOS. ZoneIn is not intended to block the iOS-level emergency calling function for 911 or your local equivalent. However, you should not rely on ZoneIn, an override, a blocked app, notifications, or any third-party app as your emergency plan.
- A paid override is available at any time as an immediate escape mechanism from an active ZoneIn block through the ZoneIn App, subject to App Store availability, Apple in-app purchase processing, device connectivity, device functionality, and other limitations outside our control. You should not use paid overrides as your sole way to regain access to emergency, medical, safety, identity, or work-critical tools.
- You accept all risks from your selections. To the fullest extent permitted by law, the Developer Parties disclaim all liability arising from or related to your choice to block any app, website, category, or service, including claims involving personal injury, death, property damage, financial loss, missed medical care, missed medication, missed work, missed school, missed travel, missed communications, emotional distress, loss of access, account lockout, loss of data, and any consequential, incidental, special, exemplary, punitive, or indirect damages.
Strong recommendation. Do not block health, safety, medical, emergency-alert, emergency-communication, two-factor authentication, password-manager, accessibility, assistive-technology, identity, building-access, or other critical-use apps. If you have a medical condition that requires active monitoring, alerts, medication adherence, device control, doctor communication, or other health-related app access, consult a qualified medical professional before blocking any health-related app.
Examples of apps you should consider carefully before blocking
The following list is non-exhaustive. It is provided to help you think about risk; it does not mean other apps are safe to block. You should also avoid blocking any other app, website, account, device function, system feature, credential, or communication channel that you may need urgently or unexpectedly for health, safety, security, transportation, work, caregiving, legal compliance, identity verification, financial access, property access, or any other time-sensitive or critical purpose.
Communications
- Phone, Messages, FaceTime, Mail, and third-party messaging apps, including WhatsApp, Signal, Telegram, iMessage, Slack, Teams, Discord, and similar apps.
- Video-conferencing apps, including Zoom, Google Meet, Webex, and similar services.
- Emergency alert and notification apps, including AMBER alert, weather alert, government emergency notification, campus alert, and local public-safety apps.
Health and medical
- Heart-rate monitoring, ECG, blood oxygen, and other vital-sign apps.
- Continuous glucose monitors and diabetes management apps, including Dexcom, Libre, and similar apps.
- Medication reminder, medication adherence, pharmacy, and prescription-management apps.
- Fall-detection and medical-alert apps.
- Mental-health crisis apps, suicide-prevention hotline apps, and crisis-support apps.
- Telehealth and doctor-communication apps, including MyChart, Teladoc, Doximity, patient portals, and similar tools.
- Pregnancy, fertility, contraception, and reproductive-health tracking apps.
- Pacemaker, insulin-pump, hearing-aid, CPAP, and other medical-device companion apps.
- Allergy, anaphylaxis, and epinephrine or EpiPen tracking apps.
- Apple Health, HealthKit-integrated apps, and any app used to monitor, record, or communicate health information.
Safety and security
- Home security and alarm apps, including Ring, SimpliSafe, ADT, Nest, and similar systems.
- Smoke, carbon-monoxide, water-leak, environmental hazard, and home-sensor detector apps.
- Personal safety apps, including Life360, Find My, Noonlight, bSafe, and similar services.
- Two-factor authentication and multi-factor authentication apps, including Authy, Google Authenticator, Duo, and similar apps. Blocking these may lock you out of critical accounts.
- Password managers, including 1Password, Bitwarden, LastPass, and similar apps.
- VPN apps required for work, school, secure access, or safety.
Transportation and navigation
- Maps and navigation apps, including Apple Maps, Google Maps, Waze, and similar apps.
- Ride-share apps, including Uber, Lyft, and similar services.
- Public transit, commuter rail, subway, bus, bike-share, and local transportation apps.
- Airline, train, hotel, and travel apps used for boarding passes, gate changes, delays, itinerary changes, and urgent travel notices.
- Car-related apps, including Tesla, connected-car apps, EV charging apps, and digital car-key apps.
- Roadside assistance apps, including AAA and similar services.
Financial and time-sensitive
- Banking apps used for fraud alerts, urgent transfers, deposits, account security, and card controls.
- Payment apps, including Venmo, Cash App, Zelle, PayPal, Apple Wallet, and similar apps.
- Trading, brokerage, and investment apps used for time-sensitive trades or alerts.
- Cryptocurrency wallet, exchange, and custody apps.
Childcare and family
- Childcare, nanny, babysitter, eldercare, and family-care communication apps.
- School communication apps, including ParentSquare, Remind, ClassDojo, learning-management systems, and similar apps.
- Baby monitor apps.
- Apps connected to child-safety devices, GPS trackers, location-sharing services, or family emergency tools.
Work and professional obligations
- Work email, calendar, chat, conferencing, file, and communication apps.
- On-call, pager, incident-response, and alerting apps, including PagerDuty, Opsgenie, and similar tools.
- Any app you rely on for professional duties where unavailability could cause harm to you, your employer, clients, patients, customers, students, passengers, coworkers, the public, or others.
Accessibility
- Accessibility apps for users with disabilities, including hearing-aid controls, screen-reader companion apps, communication boards for nonverbal users, sign-language video relay services, captioning, assistive-input tools, and similar apps.
- Any app used as assistive technology, accommodation support, or disability-related communication.
Identity and access
- Digital ID, driver’s license, passport, visa, boarding-pass, event-ticket, transit-pass, and wallet apps, including Apple Wallet and state mobile driver’s license apps.
- Building access, office access, dorm access, hotel key, smart-lock, garage, gate, and secure-entry apps.
6. Hard Mode Feature
ZoneIn may offer a setting called Hard Mode. Hard Mode is the in-app name for ZoneIn’s app-removal restriction behavior. When enabled, ZoneIn may use Apple Managed Settings functionality to prevent app removal during an active block. This feature is intended to support your self-imposed commitment by making it harder to escape a block by deleting the App.
You acknowledge that, during an active block, Hard Mode may prevent removal of ZoneIn and may also prevent removal of other apps on the device. This can affect app removal device-wide, not only removal of ZoneIn. App removal generally resumes when the active block ends or while an override is active, subject to iOS behavior and App functionality.
Your ability to toggle Hard Mode may vary depending on App settings, version, device state, and Apple API behavior. You should not start a block with Hard Mode enabled if you may need to uninstall ZoneIn or any other app during that period. We are not responsible for any consequences of app-removal restrictions during an active block.
7. Permissions and Apple APIs
ZoneIn requires or may request permissions and system capabilities to function, including Screen Time / Family Controls authorization, Device Activity, Managed Settings, Sign in with Apple, notifications, and other iOS features. If you deny, revoke, restrict, or disable these permissions, some or all ZoneIn features may not work.
ZoneIn uses Apple’s FamilyControls, DeviceActivity, ManagedSettings, ManagedSettingsUI, AuthenticationServices, UserNotifications, and related frameworks. Your device and Apple Account settings may allow you to revoke Screen Time access. If authorization is lost or Apple APIs behave unexpectedly, blocks, dashboards, schedules, overrides, Hard Mode app-removal restrictions, reporting, or shield screens may fail, be delayed, clear unexpectedly, remain active longer than expected, or otherwise behave differently than intended.
If you allow notifications, ZoneIn may send scheduled or app-triggered notifications, including a warning 5 minutes before a scheduled block begins and a one-time day-3 reminder if you download and launch the App but have not created a focus session or scheduled block.
The scheduled-block warning may use the scheduled session name in the title and the count of selected apps and websites in the body. If you edit a schedule, ZoneIn is designed to update or replace the related notification so that its timing, title, and body reflect the current schedule. If a schedule is deleted, disabled, or no longer qualifies for a reminder, ZoneIn is designed to cancel or replace the related notification where supported by iOS.
The day-3 reminder is designed not to appear if you create a focus session or scheduled block before it is delivered. It is designed to appear only once. Tapping it may open ZoneIn, present the Create Schedule sheet, and log a coarse analytics event so we can understand whether the reminder helps users complete setup.
You can manage notification permissions through iOS settings. ZoneIn does not guarantee that any notification will be delivered on time or at all. Notifications are reminders only; they do not control whether blocks start, end, persist, pause, resume, or clear.
8. Paid Overrides and In-App Purchases
ZoneIn is free to download and use. During an active block, you may be offered a paid override that temporarily disables active ZoneIn blocks. Overrides are one-time consumable in-app purchases processed exclusively through Apple In-App Purchase, with RevenueCat used as purchase and paywall infrastructure.

Prices, taxes, currency conversions, product availability, and purchase confirmations are controlled by Apple and may vary by country, region, storefront, device, time, taxes, and Apple Account settings. The Apple purchase sheet controls the final price and transaction terms at the time of purchase.
Consumption and no advance balance
Overrides are applied immediately upon activation and cannot be purchased in advance. There is no stored balance, bank, credit, wallet, or inventory of unused overrides. Once an override is activated, it is consumed. If you choose “Lock Back In” or otherwise end an override early, you forfeit the unused portion of that override.
No subscriptions or recurring charges
Overrides are not subscriptions and do not renew automatically. You must make a separate purchase each time you want a new override.
Refunds
Because an override is consumed immediately upon activation, all override purchases are final and non-refundable by the Developer to the fullest extent permitted by law. We do not issue developer-side refunds for activated or consumed overrides. You may still request a refund directly from Apple, and your non-waivable consumer-law rights remain unaffected.
Purchase failures and unsupported products
Purchases may fail or not activate if Apple, RevenueCat, the App Store, your network connection, device settings, parental controls, payment method, Apple Account, region, product configuration, or ZoneIn’s purchase mapping is unavailable, delayed, rejected, or misconfigured. If you are charged but do not receive the override, contact contact@tryzonein.com and include the approximate purchase time and any Apple receipt or transaction information available to you.
Pricing changes
We may change override products, durations, prices, names, paywall presentation, or availability. We may provide notice through the App Store listing, Apple purchase sheet, in-app notice, release notes, website notice, or other reasonable means. Pricing changes do not apply retroactively to purchases you already completed.
9. Accounts and Sign in with Apple
ZoneIn may require Sign in with Apple. Apple may provide a stable Apple user identifier and may provide name or email fields depending on your Apple settings and the authentication flow. ZoneIn may use your Apple user identifier to maintain local App configuration, purchase state, RevenueCat purchase identity, onboarding state, and related App functionality.
You are responsible for maintaining the security of your device, Apple Account, passcode, Face ID, Touch ID, and any device settings that affect ZoneIn. You are responsible for all activity on your device and through your Apple Account.
ZoneIn currently uses Sign in with Apple as its only account/login method. ZoneIn does not currently offer guest access, temporary accounts, or a custom email-and-password account system. Unless we expressly state otherwise in the App, ZoneIn settings, schedules, selections, local state, and purchases are device-local and do not restore across devices. If account deletion, purchase identity, local data reset, or privacy requests are available in the App, use those controls. You may also contact us at contact@tryzonein.com.
10. Privacy
Your use of ZoneIn is also governed by the ZoneIn Privacy Policy at tryzonein.com/privacy. The Privacy Policy explains what data ZoneIn collects or processes, how it is used, what is stored locally, what third-party services may receive data, and how to contact us with privacy requests.
ZoneIn is designed so that Screen Time selections and usage information used for blocking and dashboard features are processed on-device, but the App uses Apple services, RevenueCat, Firebase Analytics, Firebase Remote Config, purchase infrastructure, local storage, and app-extension shared storage. Third-party providers may process technical, purchase, analytics, configuration, or support-related information according to their own terms and privacy practices and as described in the Privacy Policy.
These Terms do not replace the Privacy Policy. If a privacy disclosure in these Terms conflicts with the Privacy Policy, the Privacy Policy controls for privacy-specific matters, unless applicable law requires otherwise.
11. Intellectual Property and License
ZoneIn, including its software, source code, object code, app extensions, designs, interfaces, text, graphics, icons, branding, workflows, shield screens, documentation, content, and other materials, is owned by Tash-had Saqif and Elijah Kajinic jointly, or by their licensors, and is protected by copyright, trademark, trade secret, contract, and other laws.
Subject to your compliance with these Terms and Apple’s App Store terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use ZoneIn on Apple-branded products that you own or control, solely for your personal, non-commercial use and as permitted by Apple’s Usage Rules. ZoneIn is licensed, not sold. We reserve all rights not expressly granted to you.
You may not copy, modify, adapt, translate, distribute, sell, lease, sublicense, host, outsource, publish, make available, reverse engineer, decompile, disassemble, attempt to derive source code from, bypass, interfere with, or create derivative works of ZoneIn, except to the extent such restrictions are prohibited by applicable law or permitted by open-source licenses applicable to included components.
Third-party asset, font, icon, library, and open-source notices: The App uses the Poppins font, downloaded from Google Fonts.
Trademark status: ZoneIn is currently used as an unregistered trademark.
If you submit suggestions, feedback, bug reports, ideas, or other comments, you grant the Developer Parties a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use them for any purpose without obligation to you.
12. Acceptable Use
You agree not to:
- Use ZoneIn in violation of any applicable law, regulation, court order, contract, platform rule, or third-party right.
- Reverse engineer, decompile, disassemble, modify, copy, scrape, probe, or tamper with ZoneIn except as permitted by law.
- Attempt to bypass, disable, manipulate, or defeat paid override requirements, Apple in-app purchase flows, RevenueCat purchase flows, Screen Time permissions, shields, schedules, Device Activity monitors, app-removal restrictions, or other App functionality.
- Use fraudulent, stolen, unauthorized, or chargeback-prone payment methods.
- Resell, redistribute, sublicense, rent, lease, host, or commercially exploit ZoneIn.
- Use ZoneIn to supervise, monitor, coerce, stalk, harass, punish, or restrict another person without lawful authority and informed consent. ZoneIn is designed for self-management by the device owner, not for controlling someone else.
- Rely on ZoneIn as a parental-control, employee-monitoring, medical, crisis, law-enforcement, safety, emergency-response, or other critical-use tool. This does not prevent a parent or guardian from supervising a minor’s own use as described in these Terms, but ZoneIn is not sold as a monitoring or safety product.
- Knowingly introduce malicious code, intentionally disrupt ZoneIn, exploit vulnerabilities, or access non-public systems, purchase infrastructure, analytics/configuration systems, or data without authorization.
- Provide false or misleading information, impersonate another person, or interfere with support, purchase, refund, privacy, account-deletion, or legal processes.
- Violate Apple’s App Store terms, Apple Media Services Terms, Apple Usage Rules, or applicable third-party terms.
13. Third-Party Services
ZoneIn depends on or may interoperate with third-party platforms, services, SDKs, and operating-system features, including Apple, Apple App Store, Apple In-App Purchase, Apple Screen Time APIs, Sign in with Apple, RevenueCat, Firebase, email providers, and other services. These third parties are not controlled by us.
We are not responsible for third-party services, terms, policies, content, uptime, security, accuracy, fees, decisions, refund outcomes, review outcomes, API changes, operating-system behavior, or data practices. Your use of third-party services is subject to their separate terms and policies.
14. Availability, Changes, and Discontinuation
ZoneIn may be modified, updated, limited, suspended, discontinued, removed from one or more regions, or made unavailable at any time. Features may vary by device, iOS version, country, App Store storefront, Apple Account status, permissions, App configuration, RevenueCat offering, third-party service configuration, and other factors.
We do not guarantee that blocks will start, end, persist, pause, resume, or clear at any particular time; that schedules will run exactly as configured; that Screen Time reports will be accurate or available; that override purchases will always be available; that Hard Mode app-removal restrictions will always apply or release; or that ZoneIn will be uninterrupted, error-free, or compatible with all future Apple software or hardware.
If we discontinue ZoneIn, unused advance override balances are not expected to exist because overrides are applied immediately and cannot be purchased in advance. Consumed overrides are not refundable by us except where required by law or Apple.
15. Disclaimers
ZONEIN IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” To the fullest extent permitted by law, the Developer Parties disclaim all warranties and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, availability, and non-infringement.
ZoneIn is not a medical device and does not provide medical, psychological, psychiatric, behavioral-health, addiction-treatment, ADHD-treatment, counseling, crisis, safety, emergency, legal, financial, professional, parental-control, child-safeguarding, or employment advice. ZoneIn is not intended to diagnose, treat, cure, mitigate, or prevent any disease, disorder, condition, compulsion, addiction, mental-health issue, productivity issue, attention issue, or behavioral issue.
We do not guarantee that ZoneIn will reduce screen time, improve focus, improve productivity, prevent app use, prevent website access, prevent uninstall attempts, prevent circumvention, improve health, improve academic or work performance, prevent relapse, prevent financial loss, prevent communication, preserve emergency access, or achieve any particular outcome.
You are solely responsible for your device, your choices, your blocked apps and websites, your schedules, your use of overrides, your communications, your obligations, your health and safety planning, your emergency planning, your work and school responsibilities, and all consequences of using or not using ZoneIn.
16. Limitation of Liability
To the fullest extent permitted by law, the Developer Parties will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, enhanced, or similar damages; loss of profits; loss of revenue; loss of data; loss of goodwill; business interruption; device issues; missed communications; missed work; missed school; missed travel; missed medical care; missed medication; missed alerts; account lockouts; payment issues; emotional distress; personal injury; death; property damage; financial loss; or other losses arising out of or related to ZoneIn, these Terms, your blocked selections, active blocks, overrides, App unavailability, Apple APIs, third-party services, or inability to access any app, website, account, device, or service, whether based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of the Developer Parties for all claims arising out of or related to ZoneIn or these Terms will not exceed the greater of: (a) the amount you paid for ZoneIn in-app purchases during the twelve (12) months before the event giving rise to the claim; or (b) fifty U.S. dollars (US $50).
Some jurisdictions do not allow certain disclaimers or limitations of liability, including limitations for personal injury, death, intentional misconduct, gross negligence, fraud, willful misconduct, or non-waivable consumer rights. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.
17. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Developer Parties from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use or misuse of ZoneIn; (b) your violation of these Terms; (c) your selections of apps, websites, categories, schedules, sessions, or overrides; (d) your violation of law or third-party rights; (e) your use of ZoneIn with or for another person; or (f) your attempt to bypass, manipulate, or interfere with ZoneIn.
We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with our defense.
18. Termination
You may stop using ZoneIn at any time, subject to active block behavior and Hard Mode behavior described in these Terms. Deleting the App may not be available during an active block if Hard Mode is active.
We may suspend, restrict, or terminate your access to ZoneIn for any reason or no reason, including if we believe you violated these Terms, created risk, misused payments, interfered with the App, violated law, caused harm, or if we discontinue the App or a feature.
Termination does not entitle you to a refund for consumed overrides. Sections that by their nature should survive termination will survive, including intellectual property, payment terms, disclaimers, limitation of liability, indemnity, dispute resolution, governing law, Apple-required provisions, and general terms.
19. Dispute Resolution, Arbitration, and Class Waiver
Please read this section carefully. It requires most disputes to be resolved through binding individual arbitration instead of in court, and it limits the ways you and we can seek relief.
Informal resolution first
Before filing a claim, you agree to email us at contact@tryzonein.com with your name, Apple Account email if relevant, a description of the dispute, the relief you seek, and any relevant purchase or support details. We will try to resolve the dispute informally. If the dispute is not resolved within thirty (30) days after a complete notice is received, either party may begin arbitration or a permitted court proceeding.
Binding individual arbitration
Except for the exceptions below, you and the Developer agree that any dispute, claim, or controversy arising out of or relating to ZoneIn, these Terms, purchases, overrides, privacy or data handling, marketing, support, termination, or your relationship with us will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Arbitration will be conducted by a single neutral arbitrator. The arbitration may be conducted by documents, telephone, video conference, or in person, as permitted by AAA rules and the arbitrator. If an in-person hearing is required, it will take place in New York County, New York, unless AAA rules, consumer arbitration standards, applicable law, or the arbitrator require a different location convenient to you.
Fees
AAA filing, administrative, case-management, and arbitrator fees will be allocated under AAA Consumer Arbitration Rules and applicable law. We will pay any fees we are required to pay under AAA rules or applicable law. Each party is responsible for its own attorneys’ fees and costs unless the arbitrator awards them under applicable law.
Exceptions
Either party may bring an individual action in small claims court if the claim qualifies. Either party may seek temporary, preliminary, or permanent injunctive or equitable relief in court to protect intellectual property, confidential information, security, or unauthorized access. Government agencies may also pursue claims as permitted by law.
Class-action waiver
You and the Developer agree that disputes will be brought only on an individual basis and not as a plaintiff, class member, private attorney general, or representative in any purported class, collective, consolidated, mass, representative, or private-attorney-general action. The arbitrator may not consolidate claims or preside over any class, collective, consolidated, mass, representative, or private attorney general proceeding unless all parties agree in writing after the dispute arises.
Jury-trial waiver
To the fullest extent permitted by law, you and the Developer waive any constitutional or statutory right to a trial by jury for any dispute not subject to arbitration.
30-day arbitration opt-out
You may opt out of arbitration within thirty (30) days after you first accept these Terms by emailing contact@tryzonein.com with the subject line “Arbitration Opt-Out” and including your name, the email associated with your Apple Account if relevant, and a clear statement that you opt out of arbitration for ZoneIn. Opting out of arbitration does not opt you out of any other provision, including the class-action waiver and jury-trial waiver to the extent permitted by law.
Governing law and venue for non-arbitrated disputes
These Terms and any dispute are governed by the laws of the State of New York, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement. For any dispute that is not subject to arbitration and not eligible for small claims court, you and the Developer consent to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York, unless applicable law requires otherwise.
Severability of dispute terms
If any part of this dispute-resolution section is found unenforceable, the unenforceable part will be severed and the remainder will remain in effect, except that if the class-action waiver is found unenforceable as to a claim and all appeals are exhausted, the arbitration agreement will not apply to that claim.
20. International Use, Export, and Local Rights
ZoneIn may be made available worldwide, including in the European Union, European Economic Area, and United Kingdom, through the App Store, subject to Apple availability, local laws, sanctions, export controls, technical limitations, and our discretion. We may restrict availability in any country or region at any time.
ZoneIn is provided in English. If these Terms are translated, the English version controls to the fullest extent permitted by law.
You may not use, export, re-export, import, sell, or transfer ZoneIn except as authorized by United States law and the laws of the jurisdiction where ZoneIn was obtained. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Nothing in these Terms limits rights you may have under laws that cannot be waived by contract, including certain consumer-protection, refund, warranty, data-protection, product-liability, and unfair-contract laws in your country or region.
21. Apple-Required Terms
This section applies because ZoneIn is distributed through Apple’s App Store.
- Acknowledgement. These Terms are concluded between you and Tash-had Saqif only, and not with Apple. Tash-had Saqif, not Apple, is solely responsible for ZoneIn and its content.
- Scope of license. Your license to ZoneIn is limited to a non-transferable license to use ZoneIn on Apple-branded products that you own or control and as permitted by Apple’s Usage Rules and these Terms.
- Maintenance and support. Tash-had Saqif is solely responsible for providing maintenance and support for ZoneIn as specified in these Terms or required by applicable law. Apple has no obligation whatsoever to provide maintenance or support for ZoneIn.
- Warranty. To the extent any warranty exists and is not effectively disclaimed, Tash-had Saqif is solely responsible for it. If ZoneIn fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for ZoneIn to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to ZoneIn, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the responsibility of Tash-had Saqif to the extent required by law.
- Product claims. Tash-had Saqif, not Apple, is responsible for addressing claims by you or any third party relating to ZoneIn or your possession or use of ZoneIn, including product-liability claims, claims that ZoneIn fails to conform to applicable legal or regulatory requirements, and claims under consumer-protection, privacy, or similar laws.
- Intellectual-property claims. If a third party claims that ZoneIn or your possession and use of ZoneIn infringes that third party’s intellectual-property rights, Tash-had Saqif, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with all applicable third-party terms when using ZoneIn, including Apple’s App Store terms, Apple Media Services Terms, Apple Usage Rules, Apple In-App Purchase terms, RevenueCat terms as applicable, Firebase terms as applicable, and any terms applicable to your device, Apple Account, network, or third-party services.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
22. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we may provide notice by in-app notice on next launch, App Store update notes, website posting, email if available, or other reasonable means. The “Effective Date” above shows when these Terms became effective.
Your continued use of ZoneIn after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, stop using ZoneIn and do not start new blocks. Changes that are required for legal, safety, security, or App Store compliance reasons may take effect immediately.
23. General Legal Terms
Entire agreement. These Terms, the Privacy Policy, and any additional terms presented in the App are the entire agreement between you and us regarding ZoneIn and supersede prior or contemporaneous understandings about ZoneIn.
Severability. If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, asset sale, reorganization, change in control, operation of law, or transfer of ZoneIn.
Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including acts of God, outages, Apple or third-party failures, labor disputes, war, terrorism, civil unrest, government action, natural disasters, epidemics, network failures, security incidents, or changes in law or platform rules.
Electronic communications. You consent to receive notices electronically through the App, the App Store, website posting, or email if available. Electronic notices satisfy any legal requirement that notices be in writing.
Headings. Section headings are for convenience only and do not affect interpretation.
